In 1993, the provincial government appointed Professor Mark Thompson as a commissioner to review employment standards in British Columbia. On February 3, 1994 Professor Thompson issued a report titled "Rights and Responsibilities in a Changing Workplace: A Review of Employment Standards in British Columbia" .

The report recommended that the government establish a tribunal to hear employment standards appeals.

The Employment Standards Tribunal was established on November 1, 1995 under Part 12 of the Employment Standards Act .
