Upcoming Changes – Effective July 1, 2026

The Employment Standards Tribunal advises parties and the public that significant updates to its Appeals and Reconsiderations information, Practice Directives, and Rules of Practice and Procedure will take effect on July 1, 2026.


These updates reflect the Tribunal’s ongoing commitment to improving clarity, transparency, and procedural efficiency, and to ensuring that parties understand their obligations when bringing or responding to matters before the Tribunal.

What is Changing

New and Updated Forms, Guides, and Information Materials

Effective July 1, 2026, the Tribunal will also introduce updated and newly developed forms, guides, and procedural information materials to support parties in meeting filing requirements and understanding Tribunal processes. These include:

  • Appeal Form
  • Guide to the Appeal Form
  • Appeal Process Information
  • Reconsideration Application Form
  • Reconsideration Application Form Guide
  • Reconsideration Application Information
  • Contact Information Form
  • Contact Information Guide

These materials are intended to provide clearer direction on how to complete and file applications, the information required at each stage, and the Tribunal’s procedural expectations.

Revised Rules of Practice and Procedure

The Tribunal’s current Rules of Practice and Procedure (Effective Date: December 9, 2020) will be revised effective July 1, 2026.

The revised Rules will replace the current version and will apply as of July 1, 2026, subject to any direction of the Tribunal.

New and Updated Practice Directives

Effective July 1, 2026, the Tribunal will issue a comprehensive set of new Practice Directives. These directives consolidate, clarify, and expand upon existing procedural guidance.

The following Practice Directives will be in effect as of July 1, 2026:

Practice Directives Being Replaced

The following Practice Directives currently posted on the Tribunal’s website will be replaced:

These directives will be replaced by:

  • Practice Directive 2026-018 – Usual Time Period to Complete a Proceeding
  • Practice Directive 2026-019 – Usual Time Period to Issue a Final Decision

New Public Directive – Director’s Record

  • Practice Directive 2026-008 – Director’s Record will replace an existing directive that has not previously been published on the Tribunal’s website but has been provided to parties when an appeal is acknowledged.

Effective July 1, 2026, this directive will be publicly available on the Tribunal’s website.

What This Means for Parties

Parties are encouraged to review the updated materials carefully. In particular:

  • filings must comply with updated and clarified requirements at the outset;
  • certain submissions may require additional information or documentation; and
  • failure to comply with applicable requirements may affect the processing of an appeal or application.

Accessing Updated Materials

All updated Appeals and Reconsiderations information, revised Rules, and new Practice Directives will be available on the Tribunal’s website as of July 1, 2026.

For matters filed before this date, parties should refer to the materials in effect at the time of filing, unless otherwise directed by the Tribunal.
